organise April 3rd, 2009 in economic, social and environmental Council in Paris, a conference discusses topic "Of Europe in the territories of life: social welfare at a time of the political choices".
On the eve of European elections, what balance sheet is it possible to draw of the mandature on 2004-2009 in social welfare? What new perspectives offer the mandature next?
The mandature ends in muted colours. On the one hand real knowledge: exclusion from the social welfare of directive services, decision of compatibility of state aid to some social welfare of general interest, recognition of their specificity in terms of organisation and of financing. Of other one, the absence of progress in positive legislation for lack of consensus within Council and European Committee of Social welfare system. The opposition of the Committee Barroso to go to this way puts social welfare in the field of the case law relating to SIEG. Requirements of payment by money order, of taxation of obligations of public service and of fair compensation are so put down from now on in supervision of social welfare.
And yet the mandature next is going to open with key files for SIEG and as a result for social welfare: valuation of decision on state aid, clarification of applicable right in private contract to run a public service. Besides, Parliament and Council will have with the Treaty of Lisbon of new skills in SIEG and of a frame of gouvernance clarified by the Protocol on SIG.
What strategies for social welfare 2009-2014? What markets in the movement order SSIG of the French Presidency? What are political options carried by the French candidates for the Europeans of June 7th on this file essential for the daily life of the citizens, a fortiori in the middle of the crisis economic and financial?
How do the French public authorities plan to apply the Community law of SIEG to social welfare? Will they be entirely excluded from the law of transposition of directive services?
How is going to take place the requirement of control of state aid assuring the financing of social welfare in France? Do they go towards a general implementation of public works contracts in local contractualisation or towards new adapted tools as they do allow it the Community law?
Options which will be kept by authorities will not be without consequences in the territories of life, in relations between the suppliers of social welfare and the local authorities, quality and accessibility of these services for the citizens.
What va-t- tre the general doctrine of the State in Community application of the law to social welfare? What is the position of regions with a measure of autonomy and of absorbing parts? What coherence with the process of modernisation of the territorial gouvernance hired in France, notably in definition of the missions of general interest allowed to social welfare and obligations of public service which follow from it?
